1. Read this disclaimer carefully
This Disclaimer applies to the Broker Institute of Australia Program, the BIA website at www.brokerinstituteofaustralia.com.au, BIA marketing material, social media content, free downloads, webinars, podcasts and any other communication issued by BIA. By accessing any of the above, you acknowledge that you have read and understood this Disclaimer.
2. Education only - not financial product or credit advice
BIA is not a provider of financial product advice within the meaning of the Corporations Act 2001 (Cth) and is not a provider of credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth). BIA does not hold an Australian Financial Services Licence or Australian Credit Licence and is not authorised under any such licence.
Any information about loan products, lender policies, broking practices, commissions, regulatory requirements or career economics is general in nature and does not take into account your personal objectives, financial situation or needs.
3. Not a Registered Training Organisation
BIA is not a Registered Training Organisation under the National Vocational Education and Training Regulator Act 2011 (Cth) and is not registered with the Australian Skills Quality Authority. The Course is not a nationally accredited or recognised qualification under the Australian Qualifications Framework.
4. The mortgage broker pathway in Australia
To operate as a mortgage broker in Australia, you must independently complete the relevant vocational qualifications, join an industry association such as the MFAA or FBAA, become an authorised credit representative under an Australian Credit Licence or hold your own licence, comply with applicable laws and regulatory duties, and hold appropriate professional indemnity insurance. BIA does not provide any of these items. You are responsible for completing each step independently and at your own cost.
5. Earnings, employment and outcomes
BIA makes no promise, warranty, representation or guarantee that you will obtain employment as a broker, generate any particular level of income, settle any volume of loans, obtain an aggregator appointment, or achieve any commercial outcome from completing the Course.
Any earnings, income, settlement-volume, employment, business or career examples are illustrative only. Your results depend on a wide range of factors outside BIA's control, including your background, work ethic, sales ability, network, market conditions, lender appetite, aggregator requirements, regulatory changes and business decisions.
Past results, testimonials, case studies or success stories are not an indication that you will achieve the same or similar results.
6. Currency of information
The mortgage broking industry is subject to regulatory and commercial change. Course Content reflects our understanding at the time of recording or publication and may become out of date. You should check the current position with regulators, industry associations, aggregators and qualified professionals before acting.
7. Third-party content and references
The Course and our marketing may refer to third-party websites, materials, products or services, including aggregators, lenders, software providers and other educators. These references are for information only and do not constitute endorsement.
8. Testimonials, reviews and case studies
Where we publish testimonials, reviews, case studies, success stories or student feedback, those statements are the personal experiences of the individuals identified and are not a guarantee, promise or warranty that you will achieve the same or similar outcomes.
Testimonials, reviews and case studies may be edited for length, grammar, clarity, formatting or design, but we do not intentionally change their meaning. Results vary and are not typical unless expressly stated otherwise.
Where a testimonial, review or case study involves an incentive, discount, payment, free product, referral relationship or other connection that should reasonably be disclosed, BIA will take reasonable steps to disclose that relationship where required by law or regulator guidance.
9. Reliance and your responsibility
You are responsible for your own decisions. To the maximum extent permitted by law, BIA is not liable for any loss or damage suffered by you or any other person as a result of reliance on Course Content or any BIA communication.
10. Statutory rights preserved
Nothing in this Disclaimer excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot be lawfully excluded, restricted or modified.
This document forms part of the binding legal agreement between you and Broker Institute of Australia.
