1. About these terms
These Website Terms of Use govern your use of the BIA website at www.brokerinstituteofaustralia.com.au and any free content, lead magnet, webinar, podcast, social media channel, blog or community page operated by BIA.
These terms apply whether or not you are a paying Student. If you have purchased the Broker Institute of Australia Program, the BIA Service Agreement and BIA Terms and Conditions also apply and prevail to the extent of any inconsistency.
2. Acceptance
By accessing or using the Website, you agree to be bound by these terms. If you do not agree, you must not use the Website.
3. Educational and informational nature of content
All content on the Website is general educational and informational content only. It is not financial product advice, credit advice, personal advice, legal advice or tax advice. The full disclaimer position is set out in the BIA Disclaimer.
Information is current as at the date of publication and may become out of date. We make no representation or warranty as to the accuracy, completeness or currency of any content.
4. Permitted use
You may access and view content on the Website for your own personal, non-commercial use. You may share short excerpts with attribution back to BIA. You must not copy, reproduce, republish, distribute, broadcast, commercially exploit, scrape, extract, frame, interfere with or attempt to compromise the Website or use Website content in breach of law or as training data for an artificial intelligence or machine learning system without permission.

The Website and all content on it, including text, images, video, audio, branding and code, is owned by us or licensed to us. All rights are reserved. Broker Institute of Australia and BIA are unregistered or registered trade marks of Flint Trademark Pty Ltd ACN 683 224 697 as trustee for the Broker Institute of Australia Trading Trust and may not be used without permission.
6. User-submitted content, testimonials and promotional content
If you submit any content to the Website or any BIA-controlled form, page or channel, including blog comments, questions, reviews, testimonials, feedback, photos, videos, screenshots, community posts or case study material, you warrant that you own or have the right to submit it and that it does not infringe any third-party right or law.
You grant us a perpetual, irrevocable, royalty-free, worldwide, sublicensable and non-exclusive licence to host, store, reproduce, modify, publish, communicate to the public and use it for purposes connected with our business, subject to the BIA Terms and Conditions and BIA Privacy Policy.
If your submission is a testimonial, review, image, video, voice recording, success story, result, course participation content or other material that may be used for marketing or promotional purposes, the Marketing, Testimonials, Images and Student Content Consent terms in the BIA Terms and Conditions also apply. For higher-risk or more prominent uses, BIA may still request a separate Testimonial and Image Release, written approval or further confirmation.
We do not endorse user-submitted content. To the maximum extent permitted by law, we are not responsible for any user-submitted content.
7. Links to and from third-party sites
The Website may contain links to third-party sites. We do not control those sites and are not responsible for their content, accuracy, terms or privacy practices. Links do not constitute endorsement.
If you link to the Website, you must do so on a fair and lawful basis and must not suggest any false affiliation, endorsement or sponsorship.
8. Privacy and cookies
Your personal information is handled in accordance with the BIA Privacy Policy. The Website uses cookies and similar technologies as described in that policy.
9. Free downloads, webinars, lead magnets and community events
If we offer a free download, webinar, masterclass, mini-course or other lead magnet, the same disclaimer position applies. We may use the contact information you provide for marketing communications in accordance with the BIA Privacy Policy. You can unsubscribe at any time.
If BIA hosts or promotes a community event, workshop, seminar, webinar, networking event, social event or similar activity, BIA may take photos and videos at that activity. Where attendees have been given reasonable notice through event registration terms, event communications, event notices or visible event signage, BIA may use general event photos/videos for social media, event recaps, community highlights, websites, email marketing and related promotional purposes.
If a free download, webinar, masterclass, mini-course, lead magnet or related form invites you to provide a testimonial, review, feedback, image, video, voice recording, case study material or other promotional content, the consent wording presented at the time of submission, the BIA Terms and Conditions and the BIA Privacy Policy will apply.
10. Availability and changes
We do not warrant that the Website will be available without interruption or free from defects. We may suspend, withdraw or change all or part of the Website at any time without notice. We may amend these terms at any time by publishing an updated version on the Website. Continued use after the change constitutes acceptance.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for any loss or damage suffered by you or any other person arising out of your use of, or reliance on, the Website. Where the Australian Consumer Law applies, our liability is limited as set out in the BIA Terms and Conditions.
12. Statutory rights preserved
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot be lawfully excluded, restricted or modified.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Each party submits to the exclusive jurisdiction of the courts of New South Wales, Australia.
