How we collect, use, disclose and protect your personal information

1. About this policy
BIA is committed to protecting the privacy of personal information we handle. We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
This Privacy Policy explains what personal information we collect, why we collect it, how we use and disclose it, how we keep it secure, how you can access and correct it, and how to make a complaint.
2. What is personal information
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. Sensitive information is a specific subset of personal information and receives additional protection under the Privacy Act. We do not seek to collect sensitive information unless it is reasonably necessary and lawful.
3. The kinds of personal information we collect
Depending on how you interact with us, we may collect identity and contact information, account information, payment and transaction information, content and engagement information, technical information, marketing information, communications records, consent and permission records, and user-generated, testimonial and promotional content.
This may include your name, email address, phone number, account details, purchase history, refund history, dispute records, modules accessed, completion status, community posts, support enquiries, IP address, device identifiers, browser type, login times, marketing preferences, email open and click data, records of correspondence, records of accepted terms or consent checkboxes, and testimonials, reviews, written feedback, photos, images, likeness, video, audio, voice recordings, screenshots, course participation content, success stories, results and case study material.
4. How we collect personal information
We collect personal information directly from you where reasonable and practicable, including when you create an account, complete checkout, subscribe to our email list, download a free resource, register for a webinar or event, complete a form, interact with us by email, phone, social media or community channels, participate in surveys, testimonials, reviews, feedback requests or case studies, submit or authorise promotional content, or accept our terms and consent wording.
We may also collect information from third parties, including payment processors, analytics providers, advertising platforms, referral partners, identity verification providers, debt collection agencies, credit reporting bodies where lawfully permitted, professional advisers and publicly available sources.
Our website and platform may use cookies, pixels and similar technologies to operate the site, remember preferences, secure sessions, measure performance and serve targeted advertising.
5. Why we collect, use and disclose personal information
We collect, use and disclose personal information to provide the Course and related services, provision your Account, deliver content, respond to support enquiries, process payments, manage payment plans, issue invoices, pursue overdue amounts, operate and moderate BIA community channels, communicate with you about your Account, send marketing communications, detect and prevent fraud or abuse, enforce our terms, research and improve our products and services, use authorised testimonials and promotional content, keep records of consent and withdrawal requests, and comply with our legal obligations.
We may use authorised testimonials, reviews, feedback, images, video, voice, recordings, course participation content, success stories, case studies and other student content for educational, promotional, marketing, advertising, sales, training and business purposes, in accordance with the BIA Terms and Conditions and any consent wording presented to you.
6. To whom we disclose personal information
We may disclose personal information to our staff, contractors and service providers, Kajabi, Kajabi Payments, Stripe, email service providers, analytics and advertising platforms, identity verification providers, fraud prevention services, debt collection agencies, professional advisers, any successor in our business, and government agencies, regulators, law enforcement or courts where required or authorised by law.
We do not sell or rent personal information to third parties for their direct marketing purposes.
7. Disclosure overseas
Some service providers, including Kajabi, Stripe and certain email, analytics and advertising providers, may be located outside Australia or process information outside Australia. Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles.
8. Direct marketing and the Spam Act
We send marketing communications by email and, where you have provided a number, SMS. Each marketing communication contains an unsubscribe option. You can also unsubscribe at any time by emailing info@brokerinstituteofaustralia.com.au. Transactional and account-related communications are not marketing and you cannot opt out of those while you have an active Account.
9. Testimonials, images, video, voice and promotional content
Where you provide or authorise testimonials, reviews, feedback, photos, images, likeness, video, audio, voice recordings, screenshots, course participation content, success stories, results or case study material, we may collect and use that information in accordance with the BIA Terms and Conditions, this Privacy Policy and the consent wording presented to you at checkout, enrolment, event registration, testimonial submission, survey, email or other BIA-controlled consent process.
This also includes photos and videos captured at BIA community events, workshops, seminars, webinars, networking events, social events or similar BIA activities, where attendees have been given reasonable notice through event registration terms, event communications, event notices or visible event signage. BIA may use this event content for social media, event recaps, community highlights and related promotional purposes.
This may include use on BIA websites, landing pages, checkout pages, email marketing, SMS marketing, social media, event recap posts, promotional reels, community highlights, webinars, podcasts, sales presentations, internal training materials, case studies and other BIA-controlled educational, promotional, marketing, advertising, sales, training and business channels.
For general testimonials, reviews, student feedback and standard promotional use, we may rely on the consent and licence contained in the BIA Terms and Conditions and the relevant checkout or submission consent wording. For higher-risk or more prominent uses, including identifiable images, video, voice, paid advertising, detailed case studies, specific income or career outcome claims, employer or aggregator names, sensitive personal information or other higher-risk material, we may still request a separate Testimonial and Image Release, written approval or further confirmation.
You may withdraw consent for future use of identifiable marketing or testimonial content by emailing info@brokerinstituteofaustralia.com.au. Withdrawal does not affect uses already made before your request, including printed materials, archived emails, existing campaign data, content already published or shared by third parties, or live advertising campaigns that cannot reasonably be stopped immediately. Where you withdraw consent, we will use reasonable endeavours to stop using the relevant identifiable content in new campaigns and remove it from BIA-controlled public web pages within a reasonable period.
10. Data security
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, including through reputable third-party platforms, access controls, encryption in transit, logging and monitoring of administrative access, and incident response procedures.
Despite reasonable steps, no system is impenetrable. If you believe your Account has been compromised or you have identified a security issue, contact us immediately.
11. Data retention
We retain personal information for as long as reasonably necessary for the purposes for which it was collected. Account and transaction records may be retained for at least seven (7) years. Marketing records may be retained until you unsubscribe plus a reasonable period to evidence consent. Enforcement records may be retained for seven (7) years after the matter closes. Consent and permission records may be retained for as long as reasonably necessary to evidence the consent, licence, withdrawal or related use.
User-generated, testimonial and promotional content may be retained for as long as reasonably necessary for the purpose for which it was collected or authorised, unless you delete it, withdraw consent for future use, cease to be a Student, or another retention period applies, subject to backups and records we are required to retain.
12. Access and correction
You may request access to the personal information we hold about you and ask us to correct it if it is inaccurate, out of date, incomplete or misleading. To make a request, email info@brokerinstituteofaustralia.com.au with enough detail for us to identify your records. We will respond within thirty (30) days.
13. Complaints
If you believe we have breached the Privacy Act or the Australian Privacy Principles, contact us first at info@brokerinstituteofaustralia.com.au. We will acknowledge your complaint within five (5) business days and provide a written response within thirty (30) days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner.
14. Changes to this policy
We may update this policy from time to time. The current version is published at www.brokerinstituteofaustralia.com.au and includes the version number and effective date. Material changes may be notified by email to active Students.
